Investing in Indian mutual funds and direct equities is one of the most effective ways for mariners to compound maritime savings. However, when your status transitions to Non-Resident (NRI), continuing to trade with resident Demat accounts and enduring automated AMC tax withholding requires proactive compliance.
1. Mandatory Account Migration: Updating KYC to NRI
Under SEBI and FEMA mandates, an individual cannot hold an ordinary resident Demat or Mutual Fund folio while qualifying as an NRI:
- NRE Demat / PIS Account: Allows investment on a repatriable basis using funds from an NRE account.
- NRO Demat / Non-PIS Account: Allows investment on a non-repatriable basis using domestic INR funds or NRO balances.
- You must submit an NRI KYC modification form along with your foreign address proof, overseas employment contract, CDC copy, and NRE/NRO canceled cheque.
2. Updated Capital Gains Tax Rates (Budget 2024 / AY 2026-27)
Following recent amendments under the Finance (No. 2) Act, 2024, capital gains rates have been restructured:
| Asset Class | Short-Term Capital Gains (STCG) | Long-Term Capital Gains (LTCG) |
|---|---|---|
| Listed Equity Shares & Equity Mutual Funds | 20% flat (Section 111A) | 12.5% (Sec 112A) on gains > ₹1.25 Lakhs |
| Debt Mutual Funds (Purchased post 01-Apr-2023) | Taxed at slab rates (Sec 50AA) | Taxed at slab rates (Sec 50AA) |
| Unlisted Shares / Foreign Equities | Taxed at slab rates | 12.5% (Section 112) |
3. The Upfront TDS Shock on Mutual Fund Redemptions
Unlike resident investors who receive 100% of mutual fund redemption proceeds without TDS, Asset Management Companies (AMCs) are mandated under Section 195 to deduct TDS upfront at maximum rates (20% for STCG and 12.5% for LTCG) before releasing funds to an NRI!
The only way to recover excess TDS deducted is to file ITR-2, reconcile Schedule CG, and claim a direct income tax refund into your pre-validated bank account.
4. Case Study: Chief Officer with Mutual Fund Redemptions
Chief Officer Manoj Nair redeemed ₹15 Lakhs of equity mutual funds yielding ₹3,50,000 in long-term capital gains. The AMC withheld ₹43,750 in TDS. Because Manoj's other domestic Indian income was only ₹1 Lakh (below the basic tax exemption limit), we filed ITR-2 claiming the basic exemption offset, securing a 100% refund of the ₹43,750 TDS within 32 days.
